Over the last 60 years the law has evolved to allow people to assert personal injury claims directly against the manufacturer of consumer and other products in all 50 states, and the claims may also be made against manufacturers that are not situated in the United States. The plaintiff in these lawsuits must prove that a defect existed in the product at the time the product left the control of the manufacturer and that the defect caused injury to the plaintiff. Defects may be in the design of the product, in the way the particular product was manufactured, in the instruction or warnings related to the use of the product or because the product failed to conform to some representation made by the manufacturer.
