EEOC Delays Collection of EEO-1 Data due to COVID-19
On May 8, 2020, the Equal Employment Opportunity Commission (“EEOC”) announced that the agency is delaying the collection of the 2019 EEO-1 Report due to the COVID-19 pandemic. The EEO-1 is the Employer Information Report that companies with at least 100 employees and federal contractors with at least 50 employees and a federal contract of $50,000 or more must annually submit to the EEOC. The EEO-1 is a survey that the companies described above are required to report to the EEOC that includes employment data categorized by race, ethnicity, gender, and job category.
The EEOC has postponed the filing date for the EEO-1 Report in order to relieve the burden on companies in the midst of the COVID-19 pandemic. In a press release issued by the EEOC, the agency stated the reason for delaying the filing until 2021 was to “ensure that EEO filers are better positioned to provide accurate, valid, and reliable data in a timely manner.”
Pending approval from the Office of Management and Budget, the EEOC expects to begin collecting both the 2019 EEO-1 data and the 2020 EEO-1 data in March 2021. In the same order, the EEOC also delayed the filings for 2020 EEO-3 (applicable to local unions) and 2020 EEO-5 (applicable to public elementary and secondary schools) reports and expects to start collecting those reports in January 2021. The EEOC will notify filers of the precise date the surveys will open by posting a notice on the EEOC website homepage and sending a letter to all filers.
