Although no one begins a construction project hoping to end up in court, construction disputes happen with some regularity.

The construction industry itself is fundamentally about the allocation of risk: the owner shifts certain risk to the general contractor; the general contractor allocates some of its risk to subcontractors; and all of the parties (at least should) allocate portions of their risk to an insurer or surety. With so much risk and so many parties involved, even the best contracts and project management cannot eliminate all disputes.
